Prizren, 9th of August 2016 – Basic Prosecution in Prizren has initiated investigations against N.K., B.B. and B.E., all three of them Officers in the Municipality of Prizren, based on the reasonable doubts that as accomplices they have committed criminal offense ‘Causing General Danger’, as stipulated by Article 365, paragraph 5-2, in conjunction with Article 31 of the Criminal Code of the Republic of Kosova, and commission of the criminal offense ‘Failure to avoid danger’ in accomplice, as stipulated by Article 370, paragraph 1 in conjunction with Article 31 of the Criminal Code of the Republic of Kosova.
Investigations have been initiated due to the reasonable doubts that during the time period from January until 06.06.2016, in Prizren, in the capacity of the authorized persons next to the Municipality of Prizren, in contradiction with obligations and scope stipulated by Law, three given defendants did not undertake any measure on setting equipment around houses that were prone to collapsing, for the purposes of avoiding danger, protection of pedestrians and people living in the neighbourhood. Thus, due to failing in acting by those defendants, there has come to the collapse of the old building, namely a house in the street “Marin Barleti”, on which occasion from the obtained wounds a juvenile girl has lost her life.
The defendants have also not undertaken in advance measures for avoiding the danger for pedestrians and residents living around the house prone to collapse, which was located in the street “Marin Barleti”, in the area of historical centre of Prizren, and due to not having preventive protective measures undertaken by the above mentioned authorized persons, from the obtained wounds has lost her life a juvenile girl.
