Respond to NGOs Letter regarding the Intercepted Cases
Honoured civil society,
I thank You for Your Letter which I have read with attention and at the same time I use the opportunity to honestly thank you for the cooperation we had so far, and to also inform you that I find raised concerns in the content of your letter to be legitimate and, indeed those are concerns for the entire public of Kosova.
I would like to inform you that in the same line with the statement I have provided in the Press Conference held with Journalists on 03.08.2016, I have received in the meantime the opinion of the international Prosecutor in charge of the case, and at the same day I have established the Prosecutors Committee composed of two Prosecutors from the SPRK and one Prosecutor from the Office of Chief State Prosecutor, whose obligation is analysing and evaluating all original materials/transcripts of telecommunication interceptions that were not incorporated within the filed indictment by the international Prosecutor of the Special Prosecution of the Republic of Kosova, against the former-Officials of the Ministry of Transport and Telecommunications.
Findings of the respective Prosecutors Committee shall be analysed and then according to the needs there shall consequently be in place other concrete actions.
I can guarantee you that we will act in accordance with the Law and the case shall be treated with maximum dedication and professionalism. As a Chief State Prosecutor, I assure you that no one is untouchable and if we find elements that there were committed criminal offenses, then State Prosecutor will act with all the power of Law and, liable persons will be brought before the Law. In this regard we were and we remain to be uncompromised, and the name and position that potential suspects may have are unimportant, and we will investigate all Officers` actions that are related to any criminal offense and published interceptions.
I also understand that publishing of those interceptions have caused concerns to the citizens of the country, therefore I use this opportunity to assure you and all citizens of the Republic of Kosova that State Prosecutor will act in full accordance with the Laws, in particular with the Criminal Code and Criminal Procedure Code, in accordance with Article 49, paragraph 1, sub-paragraph 1 and, we will represent public interests before the Courts of the country, and if we find sufficient elements indicating there were committed criminal offenses, in accordance with the aforementioned Codes we shall request issuance of the Orders for imposing all Measures against the respective liable persons.
We will keep the public informed regarding all actions undertaken by the State Prosecutor, within the limits allowed by investigations` confidentiality.
Lastly, allow me to inform you that as far as the last item of your submission is concerned, namely the one regarding political appointments in the Public Enterprises Boards, now we are working in a close cooperation with ACA, and we have undertaken concrete actions, whereas, at the right time we will act in accordance with legal provisions.
