Request for detention on remand against a defendant for the criminal offenses of Aggravated Theft and Forgery of Documents

 

Gjakova, February 9, 2024 - The Basic Prosecution Office in Gjakova, General Department, has taken a decision on the initiation of investigations and submitted an application for the imposing of a measure of detention on remand for a duration of 30 days, against the defendant with the initials J.K.

The Prosecution has filed an application regarding the case of defendant J.K., who stands accused of a robbery incident occurring on 25.12.2023 at a parking lot in the Malisheva shopping center. According to the allegations, the defendant unlawfully entered the premises with the intent of acquiring material gains for himself, thus infringing upon the possessions of others, including that of the injured party, E.K. It is reported that the defendant, utilizing a tool, forcibly entered the victim's vehicle by breaking its rear window. Subsequently, the defendant absconded with a bag containing various belongings, including a wallet and two identification cards issued by the German state, as well as one issued by the state of Kosovo.

At an unknown time on 07.02.2024 in Malisheva, he knowingly used the forged document as original and the driver's license as well as the identity card, both of which he used as original documents, where they contain personal data of the person identified as A.M., while the photo placed in those documents is of the defendant J.K.

The Prosecution has initiated an investigation into an incident occurring at an unspecified time on 07.02.2024 in Malisheva. It is alleged that the defendant knowingly utilized forged documents, presenting them as genuine, including a driver's license and an identity card purportedly belonging to an individual identified as A.M.

Such actions raise serious concerns regarding the authenticity of documentation and the potential misuse of personal data. The Prosecution is diligently pursuing this matter to ensure that justice is served and the integrity of legal documents is upheld.

With these actions, there is a well-founded suspicion that the defendant has committed the criminal offense "Aggravated Theft" from article 315 par.1 under par.1.1 of the CCRK, as well as the criminal offense "Forgery of documents" from article 390 par.1 of CCRK.
