The Acting Chief State Prosecutor hosted American FMCS experts in a meeting for mediation
Prishtina, February 9, 2023 - Acting Chief State Prosecutor, Mr. Besim Kelmendi together with the Chairman of the Prosecutorial Council of Kosovo and the chief prosecutors of the basic prosecution offices have held a joint meeting with American experts for FMCS mediation, chaired by Mr. Peter Swanson.
During this meeting, mediation in Kosovo was discussed, specifically the challenges of this institute.
The Acting Chief State Prosecutor, Mr. Besim Kelmendi informed the American mediation experts that the number of cases resolved through their referral to mediation has increased in all prosecution offices. We have appointed an official to each prosecution office who is charged with additional work for mediation.
Since the referral of criminal cases to the mediation procedure by the prosecutors will affect the reduction of the number of cases in the prosecution offices, the reduction of the number of cases in the courts, the saving of time for the participants in the procedure, as well as the reduction of the number of persons prosecuted, The Acting Chief State Prosecutor, Mr. Besim Kelmendi informed those present that will draft a mandatory guide for prosecutors, for referring cases to mediation.
This meeting was organized at the request of the program funded by International Narcotics and Law Enforcement Affairs (INL), Mediation Program for the Rule of Law in Kosovo, implemented by the Federal Mediation and Conciliation Service (FMCS) of the USA, who expressed their readiness for the organization of trainings and joint discussions for prosecutors and mediation officials in the basic prosecution offices, for the application of mediation.
Mediation provides citizens with a new alternative for resolving their clashes and disputes, without resorting to the court process, at a much lower cost and for a much shorter time, transparently, where the parties themselves decide on taking their own decisions, the resolution of the case and the improvement of the relations.
