THERE WAS HELD THE NEXT MEETING OF KOSOVO PROSECUTORIAL COUNCIL

Prishtina, 1st of December 2015 – There was held the one-hundred-ninth meeting of Kosovo Prosecutorial Council, chaired by Chairman of Kosovo Prosecutorial Council, simultaneously Chief State Prosecutor, Aleksandër Lumezi.

In this meeting, Kosovo Prosecutorial Council members have decided to change the location and date of the Prosecutors` Annual Conference. Thus, instead of 5th of December 2015, as it was initially planned, it will be held on 12th of December 2015. In this Conference will take place elections of KPC Prosecutor-members.

KPC members, in this meeting, have also taken the decision on establishment of the Committee in charge of reviewing the eligibility of the candidates nominated by the civil society for being members of Kosovo Prosecutorial Council. The named Committee will have the following composition: Sevdije Morina, Committee Chairperson, Bajram Ukaj and Valdrin Krasniqi, Committee members.

Prosecutorial Council members have discussed and approved: - Regulation that sets rules and procedures on State Prosecutors` Recruitment, Appointment and Reappointment, namely the Regulation that sets the vacancy announcement for State Prosecutors, drafting, evaluation and organizing of the Exam for State Prosecutors Candidates. Upon this Regulation there also are set establishment, competencies and mandate of the Recruitment Committee and Review Committee, as well as the evaluation process of the personal integrity and professional skills of the Candidates for Prosecutors, and propositions for appointment of State Prosecutors; - Regulation on Cases` Assignment, which has for purpose regulating the Cases assignment system in the Institution of the State Prosecutor of the Republic of Kosova; and - Regulation on the Normative Acts Committee, which has for purpose setting the function, organizing and responsibilities of the Normative Acts Committee, as a permanent Committee that reviews the legal basis of all Regulations and other by-laws approved by Kosovo Prosecutorial Council.

The respective Committee reviews if the respective are in compliance with the Constitution, Laws into force and existing KPC Regulations. Po sot, anëtarët e KPK-së, diskutuan dhe aprovuan kërkesën e Komisionit për Vlerësimin e Performancës së Prokurorëve, pasi që anëtari i këtij komisioni, tani ish- prokurori Jusuf Mejzini, është pensionuar dhe ka lënë pozitën e lirë. Andaj, anëtarët e KPK-së morën vendim që anëtar i ri i këtij Komisioni të jetë prokurori nga Zyra e Kryeprokurorit të Shtetit, Lulzim Sulejmani. Since, Prosecutor Jusuf Mejzini has reached the retirement age, and since he was member of the Prosecutors` Performance Evaluation Committee, the later has submitted a request for the vacant post in the respective Committee. Thus, KPC has reviewed the named request, and KPC members have taken the decision that the new member of this Committee shall be Prosecutor Lulzim Sylejmani from the Office of Chief State Prosecutor.

National Coordinator in charge of fighting Economic Crimes, Shqipdon Fazliu, today, before Prosecutorial members, has presented the Strategic Plan (2016-2018) and Action Plan on increasing the effectiveness of prosecutorial system in the fight against corruption and economic crimes, including sequestration and confiscation of unlawfully acquired asserts. KPC members have highly appraised the plan presented by Coordinator Fazliu.

They have also approved the respective Strategic Plan, with some provided remarks and suggestions. One of the agenda items was the recommending of 21 Prosecutors to the President of the Republic of Kosova, for being decreed in permanent mandate. KPC members have taken the stance that the list consisting 20 candidates shall be sent for decreeing to the President of the Republic of Kosova.

Another item of the agenda was the review of the objection of the Report of Prosecutors` Performance Evaluation Committee, from three Prosecutors. KPC members have assessed that objections of Prosecutor Armend Hamiti and Fitore Sadiku shall be rejected, whereas complaint of Prosecutor Arian Gashi shall be returned to the Prosecutors` Performance Evaluation Committee for the purposes of re-reviewing his evaluation ones again.

KPC members have today also approved the Prosecutor-Candidates List for KPC members. KPC members have said that from twenty-eight (28) nominated for members, twenty-three (23) of them meet all criteria. Whereas, five (5) of them cannot continue being part of the competition since they do not meet the necessary criteria. KPC members have also approved the proposition for transferring Prosecutor Elez Blakaj from the Basic Prosecution of Prishtina in the Special Prosecution of the Republic of Kosova. Requests of Prosecutors, Shpend Krasniqi and Rafer Halimi, for being transferred from the Basic Prosecution of Ferizaj in the Basic Prosecution in Prishtina, were also approved by KPC members. The last item of the agenda was the request of Dr. Tefik GAshi and Dr. Cen Morina for amendment of the KPC Decision (KPC/No.81/2013), issued on 22nd of March 2013.

KPC members have agreed to establish the Committee that will be in charge of reviewing their request, as well as for engagement of Forensic Experts. In the capacity of the Chairman of the afore-mentioned Committee was assigned Besim Kelmendi, Prosecutor from the Office of Chief State Prosecutor, whereas in the capacity of the members were assigned Prosecutors, Bahri Hyseni and Jetish Maloku.
