Indictment against four officials of the Enterprise Trepça JSC for Abuse of Official Position or Authority and Conflict of Interest
Mitrovica, April 15, 2024 - The Basic Prosecution Office in Mitrovica - the Department of Serious Crimes, has filed an indictment with the Basic Court in Mitrovica against the defendants H.U., Q.B., S.I., and Xh.T due to well-founded suspicions of committing the criminal offense of “Abuse of Official Position or Authority,” and against Xh.T also for the criminal offense of “Conflict of Interest.”
The defendants H.U., Q.B., S.I., are accused of intentionally exceeding their official duties in their capacities as officials of the enterprise “Trepça”JSC, and failing to fulfill their official duties in order for person A.T. to benefit, thereby disregarding the legal provisions for the regulation of competition procedures in the public sector. Specifically, the defendant H.U., in the capacity of the chairman of the commission, and the defendants Q.B., S.I., in the capacity of members of the commission for the hiring of a candidate for the position- driver manager at the enterprise “Trepça”JSC, compiled and signed the report proposing the only candidate A.T. for the position of driver, despite knowing that in this case, the competition must be repeated as there (3) candidates who met the competition’s conditions did not run for the position.
Meanwhile, the defendant Xh.T., in the capacity of the official person Acting Manager of the Company “Trepça” JSC, is accused of deliberately disregarding legal provisions, thus exceeding his powers and failing to fulfill his official duties for the financial benefit of person A.T. Specifically, the competition for the position of driving manager at the company "Trepça" S.A., which should have been open for fifteen (15) days from the date of publication, remained open for only eight (8) days. Additionally, the competition had to be repeated as three (3) candidates who met the criteria set by the competition did not show.
Furthermore, the defendant Xh.T., in the capacity of the official person Acting Manager of the Enterprise "Trepça., deliberately disregarded the legal provisions of the "Law on the Prevention of Conflict of Interest in the Exercise of Public Function" by participating personally in an official matter in which his family member had a financial interest. He took decision No. 809 dated 29.03.2019 on the employment of his brother A.T. indefinitely in the position of "Driver" in this enterprise.
Based on these actions, the defendants are charged with committing the criminal offenses they are accused of.
The State Prosecutor has proposed to the court to find the defendants guilty of the criminal acts committed and punish them according to the law.
