The 239th Meeting of the Kosovo Prosecutorial Council is held

Pristina, December 22, 2023 - The Kosovo Prosecutorial Council (KPC), led by the Chairman Mr. Jetish Maloku, has held the 239th Meeting in a row, during which the items on the agenda were discussed and approved.

Initially, the members of the KPC have expressed their concern about the dismissal from the Assembly of Kosovo of the non-prosecutor member of the KPC, Mr. Agron Beka, where the KPC has informed the public opinion through a communique last Friday that the Assembly has made a legal violation, emphasizing that the only competent institution based on the legislation in force, to examine the eventual violations of the members is the Kosovo Prosecutorial Council and its mechanisms.

In today's meeting, the KPC established the Investigative Panel for the case of a prosecutor in the Basic Prosecutor's Office in Prizren and approved the Regulation on the Internal Organization and Functioning of the State Prosecutor of Kosovo, (will enter into force on April 1, 2024) and the Regulation for Access to Public Documents of the Prosecution System .

In addition, the members of the Council also approved: the Work Program of the Commission for the Evaluation of the Performance of Prosecutors for the year 2024 and the Training Policy Document and the Needs Plan for the Training of State Prosecutors and Administrative Staff for the year 2024, which will is sent to the Academy of Law, as well as the Report for the period January-June 2023 for the implementation of the Action Plan of the Strategic Plan of the Prosecution System 2022-2024.

Consequently, in today's busy schedule, the KPC also approved two reports of the Commission for the Transfer and Advancement of Prosecutors and promoted Mr. Arben Hoti and Mrs. Fatmire Cacaj to the Department for Serious Crimes in the Basic Prosecutor's Office in Pristina and Mrs. Zana Sadiku- Sertolli and Mrs. Mimoza Shala in the Juvenile Department in the Basic Prosecutor's Office in Pristina.

The following council made a decision to open an internal announcement for the advancement of a prosecutor in the Department for Juveniles in the Basic Prosecution in Prizren and for the advancement of a prosecutor in the Department for Serious Crimes in the Basic Prosecution in Ferizaj, as well as made a decision to open of the internal announcement for the filling of nine positions of prosecutors in the PSRK, these announcements, which will be published on December 27, 2023, as well as for the release from office of prosecutor Muharrem Bajraktari due to his resignation from the Basic Prosecutor's Office in Peja and I will send the proposal to the President of the country to release him from office.

The KPC has postponed for the next meeting the review of the Analysis of the Unit for the Review of the Performance of the Prosecutor's Office and the announcement of the competition for the recruitment of new State prosecutors, due to the absence of the non-prosecution member of the Council-dismissal from the Assembly of Kosovo with what from this dismissal has caused major obstacles in the prosecutorial system of Kosovo.

At the end of the meeting, the members of the KPC dealt with the Report on the evaluation of the performance of 12 prosecutors with a permanent mandate and the objections presented and held a disciplinary hearing for the case of a prosecutor in the Basic Prosecutor's Office in Pristina.
