KPC's reaction to the dismissal of the non-prosecutor member, Professor Agron Beka, from the Assembly of Kosovo

Prishtinë - 15 December 2023 – The Kosovo Prosecutorial Council (KPK) announces that it followed today's session of the Assembly of Kosovo with concern.

In this case, the KPC notes with deep concern that in the case of the dismissal of Prof.Assoc.Dr. Agron Beka from the position of non-prosecutor member of the KPC, the highest legislative instance, such as the Assembly of Kosovo, committed a legal violation, because the only institution competent, based on the legislation in force, to examine possible violations of the members is the Kosovo Prosecutorial Council and its mechanisms.

Above all, the KPC emphasizes that today's decision of the Assembly of Kosovo is a major political attempt to interfere in the current composition of the members of the KPC, creating before the public opinion a false overview of facts and arguments, with the aim only to hinder the normal functioning of this independent constitutional and legal body. This intervention for the KPC is a violation of its regular operation.

The KPC has informed the wide opinion that the member of the KPC, Prof.Assoc.Dr. Agron Beka, has provided a lot of evidence, completely denying the baseless claims that led to this illegal dismissal, therefore the Kosovo Prosecutorial Council, through this public reaction, they finally made it known that all the insinuations of the political party in power are defamation, insults and abuse of public trust.

This is confirmed by today's decision to dismiss Mr. Beka, without having any legal argument, but only with the purpose of denigrating his figure and with the purpose of realizing their political interests, and all this after six attempts and all this after six attempts to put it on the agenda.

The KPC, assesses that the KPC member, Mr. Agron Beka, during his engagement in the KPC did not have any remarks in the exercise of his duty and no violations and even less procedure, but with his work and professionalism shown has helped the prosecutorial system and the KPC in the performance of constitutional duties and responsibilities.

The Kosovo Prosecutorial Council expresses its conviction that Mr. Agron Beka has acted within the framework of his authorizations as a member of the KPC and this assessment cannot be made by anyone other than the body where he works and acts. But now the trend has taken off and his dismissal is an undeniable proof that there is an attempt to take control of the most important constitutional institution, which is the foundation for maintaining legal security in this country. 

The KPK announces to the general public that it will use all its constitutional and legal mechanisms to contest this illegality that the government did to the KPC today.
