NOTIFICATION FROM THE SPECIAL PROSECUTOR'S OFFICE OF THE REPUBLIC OF KOSOVO

Prishtina, 19 May 2022 - The Special Prosecution of the Republic of Kosovo (SPRK), notifies the public opinion regarding the article published in "Koha.net” with the title "Survivor of the Dubrava massacre demands that the Prosecution wake up".

The Special Prosecution Office informs the public that investigations on the Dubrava case are ongoing. For the correctness, we inform you that initially, this case was suspended due to the absence of the defendants and the legal deadline of 2 years of investigation. However, with the approval of the amendments to the Code of Criminal Procedure, in June 2021, in which case the deadline for investigations was removed and the trial in absentia was allowed, the criminal file was reactivated for investigative procedure.

At this stage of the proceedings, investigations have managed to identify about sixty (60) victims of the Dubrava case, who were interviewed, including Enver Dugolli and Bedri Kukalaj. According to the case file, Enver Dugolli was interviewed on 06.11.2013, while Bedri Kukalaj was interviewed on 04.08. 2011, by the EULEX Prosecutor in the SPRK.

So far, investigations  have identified forty-four (44) defendants who are suspected of being involved in committing the criminal offense "War crime against the civilian population" sanctioned by article 142 in connection with article 22 of the Criminal Code of the former SFRY  as a law in force at the time of the commission of the criminal offense, currently sanctioned by article 146 in connection with article 31 of Code no. 06 / L-074 Criminal Code of the Republic of Kosovo (hereinafter "KPRK").

In this case were identified sixty (60) injured and one hundred (100) witnesses who were interviewed by law enforcement agencies.

The SPRK informs that they are undertaking investigative procedural actions in order to fully clarify the case, but due to the confidentiality of the procedure, more information can not be shared for the public.
